Legal Question in Landlord & Tenant Law in California
Landlords illegally entry, damaged property & locked out
Can someone please help us? Our landlords broke into our house vandalized our personal property threw all our belongings in front yard and locked us out! We had until November 1st to get out- that's what the evicition papers stated when we recieved them October 19. September 30th they gave us a 30 day notice then september 15 I got a 3 day notice landlords never showed on 3rd day. September 25 the landlords had our electricity turned off. It was in an old tenants name and we figured we'd be able to reinstate the electrity in our name but the landlords wife went to pg&e and told them not to allow anyone other than the owners of the house could reinstate pge services, thus we were left in the dark for the month of october. Food went bad couldn't pack and college attendance has suffered greatly. Landlord at the time had promised to help us hook it back up but never did. throughout the entire month of October the landlords wife has repeatedly sent us threatening text messages. Yesturday the landlord served us with an unlawful detainer with no date or clerks signiture on the summons but there was a court number which was cv080780. We don't know what to do to retaliate against these wrongful acts from our landlords. Please help us!!

Re: Landlords illegally entry, damaged property & locked out
You should talk to a tenants rights attorney to see if you can file a cross complaint against the landlord for retaliatory eviction and other damages that may have ensued for breaking into the apt.
As always please contact an attorney in your area before taking legal steps.
Good luck,
