Legal Question in Landlord & Tenant Law in California
My landlord's manager committed fraud to my family and I. She kept money from our rent and made it look to the owners of the apartment complex as if we were not paying all of our rent. The owners came to our apartment and told us they were ready to start the eviction process but we showed all the received that we had been paying our rent. The manager even wrote a letter as if we wrote stating a payment plan and a good faith letter saying why we were always late and not paying all of our rent. Which we never wrote!!! She even signed it as if it was us. She was even harassing us that the manager wanted last months rent when it's illegal to ask for last month's rent to my understanding. I guess the owners decided not to fire her after the fraud that she did and she is still working for them. I have a copy of the letter that we supposudely wrote which we never wrote and have all the receipts that we have always pay our rent. I was wondering on what I should do? Thank you

You should write to the owner and demand that something be done as to the manager, and that certainly you not have to deal with her anymore. Your rental checks should be sent directly to the owner. Ask the owner for some form of compensation for what was done to you. Point out that the manager acted in an apparent criminal fashion [but do not demand any compensation for not reporting her crimes as that would be extortion]. ask to meet with the owner to be able to show him the receipts and that the signatures are phoney. The manager is likely to try to get back at you so you need to alert the owner to that.
