landlord/tenant issue

Is it legal for a landlord to require rent to be paid on the 3rd (third) of each month with no leeway (after 5:00 PM on the 3rd rent is LATE and requires a $25.00 late fee)?

Seems harsh put possible.

Dear Marisa:

Read the provisions in your lease, and if you agreed to pay on the 3rd by 5 P.M., then landlord is within his rights.

Late fees are not legal in California, but most judges ignore that fact. It is better to just pay on time, and if unable, pay the late fees.
