Legal Question in Landlord & Tenant Law in California

lease agreement

I signed a contract for a one yr lease for an apartment. Last minute we backed out and decided to not rent it, I gave the owner $1200.00 towards 1st months rent. She agreed to let us get out of the lease, due to our financial situation. Now she is keeping my money. We never occupied the apartment. Can she keep the money, or is there something I can do about it? I really need this money, it was everything I had.

Re: lease agreement

A lot depends on the contract you signed, and the provisions.

Normally, you lose. Were there any witnesses to her agreeing to let you out of lease?

She can probably keep the money. Read your contract provisions.
