It depends who's doing the "considering." That is probably the most contested issue in partial return of security deposits in small claims court. Many landlords think that nothing is "normal wear and tear," while tenants think that the longer they're there, the greater chance that "wear and tear" is normal. It depends how much money is at stake as to whether you bring a small claims action. You might try to negotiate with the landlord on that issue.
