Legal Question in Landlord & Tenant Law in California

I am the only one on the lease. I had a sublet that paid month-to-month with no written agreement who didn't leave after the 30 day notice but still paid the rent to my landlord. The sublet then left just before the month had finished with no notice to me. I have dismissed the case all together. Am I now able to keep the sublets portion of the deposit? This takes place in California.

It is unclear who gave the 30 days notice. You stand as a landlord in relation to the sub-tenant; if any rent was owed you is unclear. It could be deducted from the security deposit. Be sure to give the subtenant notice within 21 days of what you are retaining and why.
