Legal Question in Landlord & Tenant Law in California

Legal Information on How to Write Out My Situation

What ca I do about the following problem? I moved in with other family members. My problem is my sister was served with notice to file properly typed legal form within 5 days as she didn't pay this months rent as she is leaving at the end of this month. When she was served with 3 day notice to vacate she told the landlord I had already moved out before the end of last month. Because my name is still on the rental agreement which I'd from month to month I have to file these papers by Friday. I just received notice from my sister. Anyway 2 things I don't know how to write this in legal form to file with the courts, is there anything I can do about this as I'm already out and not even in town, what can I do about all of this and I thought when you were evicted you had 28 days.

Re: Legal Information on How to Write Out My Situation

All persons living at the residence must be served with the eviction papers. Then, you have to file an answer within 5 days. If you don't answer, the landlord will take your default and obtain a judgment of eviction. If he never served you, then, technically, he has not complied with the eviction laws. Please consult a local attorney to review the documents that were served and the legal paperwork. Good luck and thanks for inquiring.
