Legal Question in Landlord & Tenant Law in California

Legality of Landlord Withholding Mail

After moving in to a new residence where we are renting a room with an attached private bath, our landlord announced that we were not allowed to receive any postal mail. My girlfriend and I were shocked. My question to you is: Is it legal for our landlady to stop us from receiving mail?

Talk to a postal official about that. It seems that your landlady doesn't want anyone to know -- including the letter carrier -- that she is renting out space in her place.

Re: Legality of Landlord Withholding Mail

Ask her to show you where in the lease agreement you agreed that you cannot receive postal mail. If she cannot point you to something, tell her that she cannot prevent you from receiving postal mail at the home. Problem is, if you have no lease, or a month-to-month lease, she can change the terms of the lease on 30 days notice. Can she put a clause such as this in a lease? I'm not sure and would have to research the issue. I'd start with questioning her about where you agreed to that, and if she does change your lease, then you'll probably need to pay someone to do that research as its not an "off-the-top-of-my-head" question.
