Legal Question in Landlord & Tenant Law in California
I have been letting my friend stay in my rental in exchange for babysitting. Yesterday, I noticed money from my wallet missing again, and went home to confront her. When I opened the door, I caught her smoking in my house. This is against my rules and is very dangerous to my family's health. I told her to take her property and leave. She wrote me a letter stating that she will take legal action if I do not let her stay 30 days. Is the 30 day law still valid if she is doing illegal activities and putting my family in danger? We are in California.

She is not a tenant. She has no legal standing for you to evict. You can call the police and have her removed.
