Legal Question in Landlord & Tenant Law in California

I live in an apartment complex and my upstairs neighbors are driving me crazy. I have had to call security on them more than a dozen times. I have spoken to the manager and she said that there have been other complaints on them and that they will not be renewing the lease at the end of January 2011. I have been awaken at hours ranging from 11:00 pm to 3:00 am. each time I call security and the office and leave messages. Nothing to this day has been done. I am so upset that I am in tears. I really need to do something. This is my health that is starting to suffer. I am not sleeping like I should and the simple fact that now I am hypersensitive to the noise now.

Please help me get to the bottom of what I can do.

You can move, or you can sue the landlord and/or possibly the other tenant. If you are going to sue, you will want to retain an attorney as these kinds of cases - breach of the covenant of quiet enjoyment are not easy to plead or win. Either way, you will almost certainly not get relief any sooner than the end of January if the tenant actually leaves.
