Legal Question in Landlord & Tenant Law in California
I live with the father of my 3 small children and we rent a house in East Palo Alto Ca from his mother. I have been staying with friends for the last 3 weeks because my living situation has become unbareable. My boyfriend has gone so far as to say he will kill me, himself and the kids if I dont come back to him. The kids are staying with his mother for spring break. I filed a restraining order against him and they ordered a police escort to go with me to get the kids from his mom so I can go home. we cant find him to serve the order and his mother has changed the locks on my house today and started moving out my things. what can i do to make it so I can go home with my kids tonight?

Contact his mother, tell her that you fully understand that she wants to support her son but she has established a business relationship by being your landlady and her failure to comply with the law is both illegal and harmful to the children. With her son having threatened violence against you and the children, you can not let the children stay with her as she will let him into her home. Does she what the children to stay in a homeless shelter? Her moving your items out means she is liable for their value and a court would double or triple the damages. You have no current choice but to go back to her rental house to live there. For the sake of her "grandchildren" will she not compromise?
