Legal Question in Landlord & Tenant Law in California
I live in Los Angeles County, California. After an Eviction (im fighting) My landlord is holding all my personal property in storage units. She put all of my property in the units the day before my moving truck was scheduled and I was going to move my own property. I was moving some valuables out of the house the day prior to when she hired a moving truck when I noticed some very expensive items missing. I filled out a police report and the landlord is aware of this. Now, she wants me to fill out a release of liability form to release my property to me. I am missing over $100,000 worth of property and the landlord was holding the keys to the house. Will this release excuse her from the police investigation? She could be prime suspect.

There are statutes that govern personal property left in rental premises after an eviction. They are set forth at Code of Civil Procedure section 1174, subdivision (e). You mention that you are in an eviction, so I am assuming that this was a lawful eviction, and not some form of "self help" that the landlord performed on his or her own.
