Legal Question in Landlord & Tenant Law in California
I live in the state of California. I have a two year lease with my landlord in a home. The lease is until March of 2012. I found out that my landlord is not paying the house note and has not made a payment sence August.
What happen if I am forced to move before my lease is up?
Can my landlord contiune to take my rent money and not pay the house note?
Thank You

Your landlord is entitled to do whatever they want with the rent money. Under current law, if the house is foreclosed on, you will still be allowed to live in the house until your lease is up, as long as you fulfill all your obligations under the lease, just as if the house had not been foreclosed. The only difference being you would start paying rent to the new owner.
