Legal Question in Landlord & Tenant Law in California

I have been living in my apt for 3 months and have repeat, severe stomping noise from my upstairs neighbors that wake me up every 3 hours at night and prevent me from sleeping. Issue has been raised to Apt manager multiple times, they took 1 month to act, after we provided a few recordings of said disturbances.

They sent 1 formal notice to the tenant but admitted that they cannot do much such as evicting him anyways during the moratorium. Tenant keeps being loud and waking me up at night so I cannot stay here anymore. Can this serve to justify me rescinding the lease and moving immediately as I am being forced out and my right to quiet enjoyment has not and cannot be maintained? I want to avoid paying any breaking fees obviously as well as paying the rent under any 30- or 60- days notice.
