Legal Question in Landlord & Tenant Law in California

missed payment for month of june

I own a photo developing store and I missed paying the rent for Month of June. Today, I received a summon from the court saying that there's been a lawsuit filed against me and that I need to notify the court in 5 days. Month of June is not even over yet and can this really be done? What do I need to do next? Do I need to hire a lawyer to resolve this?

Re: missed payment for month of june

You have been served with an unlawful detainer (the legal word for an eviction).

I am tied up with clients now, but I realize you must be quite apprehensive.

I will answer your questions as thoroughly as possible, probably late afternoon or early evening.

Do not panic!

Re: missed payment for month of june

You probably have been late more than once, and the landlord is evicting you.

First, if you have the money, see if you can negotiate with the landlord, but you must be able to pay now, and be aware that his court costs may already be over $500, which I am sure he'll want reimbursed.

You have 5 calendar days to file an answer, starting at midnight tonight. Court holidays (July 4) don't count...so you have 6/30,7/1,7/2,7/3, and the 5th of July. You must file an answer by July 6, or you will be evicted shortly thereafter by the sheriff.

Do you have any defenses? Why didn't you pay? You have to come up with valid reasons for being delinquent.

You probably do need a lawyer, especially if you can't work it out with landlord.

I can't give you more information without more facts pertaining to your delinquency.
