Legal Question in Landlord & Tenant Law in California
We have had mold in our apartments growing since we moved in a year ago. The manager admitted that the right steps were not taken to remove it. Now we have also had water intrusion since June. They have not done anything to fix it and we have put in multiple work orders. It floods our hallway every single night. They also recently discovered water running through our electric system in one entire wall, deeming it dangerous but not fixing nor relocating us. Our kids (well teenagers) have been experiencing cold-like symptoms for quite a few months that we are starting to believe is related to the mold, which they have still not removed. We called the Building Code Inspector and they called the manager and told him they 3 days to either relocate us or fix the problem. Neither has been done and it is the final day. Do we have a case against our complex?

You probably do, but your case becomes much stronger if you follow through the entire Code Enforcement process. I recommend you contact Code Enforcement and report that they have failed to comply with the 3-day order. They can act against the landlord much more quickly than you can through a lawsuit, and the longer the landlord fails to comply with their orders the greater your right to recovery of damages against the landlord.
