Legal Question in Landlord & Tenant Law in California
I moved in with a friend during harsh times, rent was never discussed.. he had an extra room in his house which had been rather neglected and he wanted help with. I had the know how & tools to do so. It seemed to be a perfect arrangement & it was. Until 2 years ago he left out of state and left the house behind with me and his two teenage kids still residing in it. I have lived here 5 years and was given a "3 day notice to quit" today. It was printed from a web site of some kind; it was NOT filed with any court or legal entity & was given to me by the daughter (19yo) on his behalf. Shes telling me she's going to remove me and my belongings at the end of those three days, period. I know by law she had to do the eviction process through the court system but she seems to think otherwise & therefore will most likely procoeed with a "self help evicition. What do I do? Please help me, I dont have the resources to make myself and a house full of my belongings disappear in 3 days.. especially in the middle of a holiday weekend anybody? Please?

Have a lawyer inform her and the property owner in writing that she must follow the legal process. In addition, the three-day notice might be defective if it's not for rent but only JUST BECAUSE. Since you've been there more than 2 years, it might have to be a 60-day notice. There also might be rent stabilization laws in effect in your locale, so you should check into that, as well.
Of course, if she starts messing with your things, it might be a law enforcement matter, as well.
