I moved into my husbands rent controlled apt 7 years ago, but my name is not on the month to month contract. What happens if he passes, can I be evicted?

Your name does not have to be on the lease to be a tenant. Occupancy of the property with the landlord's consent in exchange for rent creates a tenancy. Furthermore, California law prohibits discrimination based on marital status.
