Legal Question in Landlord & Tenant Law in California
neighbor complaint to landlord regarding autistic son
I'm not sure what are of law this would pertain to. I just moved into a new apartment in May 2007 with my 4 year old autistic son and 6 year old adhd son. The landlord welcomed us and my son's. I just recieved a certified letter from him stating Im in violation of my lease. That the neighbors have complained about the noise. My 4 year old is semi non-verbal and when he is excited he ''stems'' with a loud EEEEEEEE...Its how he expresses himself. I admit its irritating but not loud enough for the neighbors to want me out. I can't stop my son from this. Now I am constantly telling him to ''use his quiet voice'' and ''don't EEEE''. I feel terrible. They have also accused my 6 year old of urinating in the back yard and that the odor is so strong that they cant go out side...B.S.....Never has my son urinated in the yard, and if he did, the amount of urine he would have to produce to make going outside unbearable would be quite alot...Its rediculous...Should I respond to his letter? Should I contact a lawyer just to protect myself for any future aligations or ''violations''

Re: neighbor complaint to landlord regarding autistic son
I would respond to the letter, and advise landlord of the facts as you present them here.
Unfortunately, if landlord believes your neighbors, and not you, there is little you can do.
At this point, there is no need to retain a lawyer, though there may be shortly.
Please feel free to e-mail, or call, my office if you need more.

Follow Mr. Bennett's advice. Draft a letter (certified) to the Landlord explaining everything as you have in your question.
