Legal Question in Landlord & Tenant Law in California
neighbor smoking
I live in a townhome and my neighbors smoke at all times. They smoke cigarettes and cigars out on their patio and it fills my unit. We do have air conditioning so we have to keep the windows open in order to cool off. We have 5 kids and so do they.

Interesting question. The courts have never dealt with this, but I doubt you can prevent it.
There is no law, at present, regarding smoking outside, and while I understand your concern, I think you have to live with it, especially since you have A/C.
