Notice of termination

I've been renting a house to a relative for over five years with no lease. He stopped paying rent November of 2006. I have asked him to move out on numerous occassions. He agrees to move out but never actully does. I was researching eviction atorney fees and they range in price from $1000.00 to $1500.00. Is there a more affordable way to evict this tenent?

I doubt it is worth the risk of doing it yourself. Hire an attorney.

You could try to do it on your own, in pro per, as a plaintiff representing himself is designated. I wouldn't recommend such an approach, however, since the costs involved (i.e. not the attorney fee portion) are almost $500. of the fee.

Get a good attorney and pay the fee for him/her to do the work. In the long run it should be cheaper, faster and less stressful.

You can draft and have served the three-day notice by yourself. You can file the unlawful detainer lawsuit yourself. But, if you mess up, then you have to start from scratch.

You might try a landlord's legal group and negotiate a smaller flat fee that covers not only standard uncontested eviction but also a contest including cost of trial. Make sure all terms are in writing.
