Legal Question in Landlord & Tenant Law in California

Am I A Nusiance?

I am in legal straits because of a pot bust in 2002 and another pot bust in 2004. The landlaord said that I am a Nusiance because of the arrests. I haven't had my day in cour on either of the charges; however the landlord said that I was in defalt of the month to month lease agreement. He said that I had used the premises for illegal purposes - to wit growing marijuana and opium. Because I haven't been convicted of either of these charges, is he within his rights to evict me, even though I WILL be proven not guilty (think positive!) My question, how can he evict me even though the state has not convicted me of anything?

Re: Am I A Nusiance?

You are on a month to month rental. He can evict you for any reason by giving a 30 or 60 day notice to terminate the tenancy.

Did you ever hear that old saying ... where there is smoke, there is fire.

I would suggest you change your life as well as get ready to move. I hear that education helps.
