Legal Question in Landlord & Tenant Law in California

My obligations for a lease after relationship ends

Two people dating decide to relocate to California. Man picks out apt on his own, signs lease on his own, doesn't even tell me (woman) the rental amount, never asked for payment of rent or 1/2 rent (I'm surprised I was told the address, in hindsight). Due to my job travel requirements recently (and other factors), the relationship tanks (after 2 months in new CA location). He is asking me to pay 100 percent of the rent, up front, in exchange for him staying away from me and leaving me alone.

Tell him:

1. He signed the lease, and it is his obligation.

2. If you are going to spend money, you will spend it filing for a restraining order against him.

Re: My obligations for a lease after relationship ends

I am a little confused. Are you currently residing in the apartment, and is that why your ex wants you to pay the rent? At any rate, you have no legal obligation to pay the rent because you never agreed to. In order to evict you legally, your boyfriend must give you a 30 day written notice. Of course, if the rent is not paid then the landlord will post a 3-day notice to pay rent or quit on the door. Either way, you will still probably get close to 30 days without your name being reported on your credit report, so enjoy the free rent! If your boyfriend gives you any more trouble, you can call the police or get a restraining order.

Asking you to pay off his lease in exchange for him not stalking or harassing you sounds like extortion. e-mail me at [email protected] if you would like more reliable advice based on more detail, but on the face of it, it sounds like you are being criminally victimized.
