Legal Question in Landlord & Tenant Law in California

What are my options on getting roommate out

My roommate G has lived with me since May 2006, I dont pay rent, the house is owned by a family member, but I pay the phone, cable and garbage. The propane and electricity are paid for by my aunt. G helps out around the house, fixing things, painting etc... About 2 months ago our county sherriff came to our door looking for G on a warrant. they finally got him and now he is doing 65 days on the home monitoring program and he is only 3 weeks into it, He has become unbearable. He is mean, nasty and purposley makes things difficult. He doesnt lock up at night....leaves my dog outside all night (I work nights) and wont clean up his own messes....I cant deal with this anymore. With him on this program, what can I do to get him out of my house. He is watching porno on the livingroom tv and doesnt care who is here. He quit doing repairs and maintenance and says he doesnt have to leave because of the home monitoring and then I will have to evict him after that 65 days is up and that could take up to 90 more days.....HELP..........

His home detention shouldn't be your problem.

If he has a probation officer, you might consider speaking with him/her. Also, there's no reason the homeowner can't serve a 30-day notice to quit, although he'll probably become even more surly. Good luck!
