Legal Question in Landlord & Tenant Law in California

overstayed family members

My mother and I are co-owners of the house. A year ago my brother, wife, and three children came to stay in March of 2003 with us for only six months to a year. My mother said she would pay their rent while they stayed. My mother has only given me one payment. My brother has overstayed his visit. I want my brother and his family to leave How do I get them out. It has been a burden to me financially, and a streesful enviroment for my three children.

Re: overstayed family members

You will need to evict them. They have tenants rights.

Suggest you sit down and talk to them about the situation. Explain the burden and help them with other options if possible. Is your brother working? Can he get state or federal assistance to help with rent? Try to mediate first.
