Legal Question in Landlord & Tenant Law in California

Overstaying Your Welcom

Trying to help sister get on her feet. She moved in 2 years ago to look for a job. She still hasn't found one and I would like her to move out. I was told you cannot just kick someone out of your residence even if they are not on the lease. What legal paperwork or forms do I need to have her vacate these premises?

Re: Overstaying Your Welcom

You need to have her served with a 30-Day Notice to Quit. If she doesn't move out, then you need to file an eviction lawsuit called an unlawful detainer. Because an eviction lawsuit is an expedited court process, the rules are what some would describe as hypertechnical. I would not try to do this without an attorney.
