Legal Question in Landlord & Tenant Law in California
Owner with Renter Negligence
I live in a first floor condo, and the unit above me caused a leak. The owner of the unit above me said that she would have everything fixed because of her renter's negligence. The owner had a vendor come into my unit and inspect. They began to tear down my drywall due to the leak, and to not cause mold to occur. Once everything was dried, the owner recieved the estimates for the repairs. She later backs out and says that the cost is too much for her and that her insurance was not going to cover it because it was her renters' negligence. She later tells me that I have to go after her tenants but I feel that she is responsible. Is the owner still liable for the cause of the leak?

Re: Owner with Renter Negligence
How about your insurnce company? She may be. Let a court decide. If it is less than $ 7.5K then you may take it to small claims court and sue both.
