Legal Question in Landlord & Tenant Law in California
"I am in a course which I paid $1400 for and cannot miss or I will be dropped from it. It runs all day mon-fri. I came home and my roommate said he had recieved papers from the court for me. I wasn't served properly nor can I appear at the court until the the end of the course. I woulnd't even have been able to recieve these papers until the end of the course which is in June. What do I do? I can't go to the courthouse until June to respond.
1 Answer from Attorneys
If this is an unlawful detainer (eviction) lawsuit, you must file a written response within five days of your roommate's receipt of the documents. If it's some other kind of lawsuit, you have 30 days from the date of receipt. These are not dates you need to appear in court, but only file the paperwork with the court and send a copy to the other party's attorney. You might be able to negotiate a settlement with that attorney or at least agree to postpone any court proceedings until after you're done with school.
