Legal Question in Landlord & Tenant Law in California

i paid my rent for dec with a check and got a reciet also from the company, i just got a 3 day pay or quit saying i owe 250 pluse added late fee of 50.00 now close to a yr ago when the company bought who we use to rent to they are saying i still owe 250 for feb 09 rent i cant find my reciet so i did pay some on it mos ago i think they are taking from my current rent i just paid to pay that and now they are saying i didnt pay my current when i did. i my check i put for dec 09 rent.. can they do that?

Yes if you owe them the money they can go back up to 1 year , so it doesn't matter what you put on your check it matters what they put on their 3 day notice. If they didn�t tell you that then their notice may technically be defective and provide you a temporary defense.

I would suggest talking to them and trying to work something out so you both don't end up in court.
