Legal Question in Landlord & Tenant Law in California

Parking in an apartment complex.

I live in an apartment complex where we had to have a vehicle sticker to park in the lot. Now it seems any one can park in the complex with out the sticker. Do we have a right to complain: space is limited, and my brother had his car towed after paking in the lot after a few minutes. Signs outside the complex state, if a car with out the sticker, is parked in the lot it will be towed. Can we get the money for the parking sticker and the tow returned.

Re: Parking in an apartment complex.

No, I doubt it.

The owner of the complex has the right to make rules, as the parking lot is on private property.

They don't enforce the rules all the time, but on selected occasions. It is similar to exceeding the speed limit. Because you don't get a ticket, does not mean you are not breaking the law.

You can file a law suit in small claims court, but I doubt you could win.
