Legal Question in Landlord & Tenant Law in California

Parking

We bought a one bedroom condo

which came with 1 parking space. My

husband and I both have cars. The

second car is not allowed to park on

the premises, because the home

owners says these spaces are

reserved for ''guests'' and will tow

any resident who parks there. So

there are no parking options in the

gated community. The city will not

allow us to park on the street.

Residents have resorted to parking

across the street however a new

company has moved in and word is

that they will start towing residents

as well. Any advice?

Re: Parking

I would like to give you good news, but I cannot,

I am assuming you are dealing with a homeowners association (HOA). They can make their own laws from the rules and regulations (CCR's).

Courts have over and over again refused to deal with HOA's.

Thus, the rules are the rules. Therefore, you can't change the one car rule.

Your zip code is that of Roseville. I'd check with the proper city authorities and find what you can do to change parking rules

I'd also get together with others with two cars, and band together. and see if you can all attend an HOA meeting, and try to get the rules changed.

That is my advice.

Good luck!
