Legal Question in Landlord & Tenant Law in California
Parking Issues....
I have a year's lease on a 2 bedroom & 1 bath apartment unit which I share with a roommate. There are 200 apartment units in the complex. It is not a gated complex. We were given 1 reserved parking spot. My roommate has the reserved parking spot. There is approximately 100 available non-reserved parking spots for anyone on the premises - friends, tenants, etc. Obviously not enough for everyone in the complex! When I come home from work I more often than not can't find an available spot to park my car. I can't park on the street because the city doesn't allow overnight parking! The complex does not issue parking permits for tenants. I have asked for a reserved spot of my own(an additional $25 a month)but was told by management that there is a 1 year waiting list and that there's no gaurantee I would ever get a reserved spot for my car! I have spent 75 nights out of the 4 months I have leased my apartment at a friend's house because I have no place to park my car! I have told the management of my issues and they refuse to listen. They state that I have a signed lease and regardless if I spend no time in my apartment I still have to pay the full amount of rent or face the consequences! What legal options do I have??

Re: Parking Issues....
I hate to say it but, if parking your car is so important, you might have to contract with others elsewhere or move to a place with an additional parking space.
