Partial Security Deposit
I received a partial security deposit refund check from the landlord. I would like to know if a can cash it and sue him for the balance.
I left the apartment under California CC 1942, sued the landlord for breach of the covenant of habitability and quiet enjoyement, and won.

Yes. Cash it unless you are disputing amount to be returned, and he/she writes "paid in full" on the endorsement line on the back of the check.
