Too many people in rental property

We own a 3 bedroom 1 bathroom house. After visiting the property, we noticed that there were at least 12 people living there. That's at least 6 more than was listed on the rental agreement. What are my options?

The actual rental agreement terms should lawfully dictate the "end result" if the tenant's breach this provision of your agreement. Have a 3-day Notice to Perform or Quit served on the all tenants on the lease agreement. If they don't cure the breach within 3 days, start an eviction proceeding. Good luck.

You may evict a tenant for a major breach of contract. If the tenant has 9 people living in the rental and the contract calls for 4 people, this could qualify as a breach of contract and facilitate an eviction process. Seek out a competent Landlord/tenant attorney who emphasizes evictions, such as our office.
