Legal Question in Landlord & Tenant Law in California

ok I have a question about renters rights ... I rent an apartment and I have many problems in my apartment .... my heater hasn't worked since october 09 .... the tub water comes out brown sometimes ... wall out lets dont work and I mean only 1 works in 1 bedroom none in another I have to run extensions cords to plug stuff in there.. plugs in kitchen and living room dont work ... there are big gaps in my front exterior door frame ... roaches .... drug dealer next door and he's always getting arrested and breaking windows... and I guess my last straw was my toilet broke and I called my apartment manager and told her that the toilet was not working it was so bad that it won't even pull the toilet paper back and flush at all and she told me to buy a trash can and when done wiping to not flush the paper and take my trash out every day ....and if she sends a plumber she will charge it to me ..... Help me please !!! Thanks -melody

You need to either find a local housing agency (start with the City or County in which you live's code enforcement department) or hire an attorney to make the landlord understand that these conditions are not acceptable. In some instances, the City or County code enforcement in response to a complaint from a tenant will come out, inspect the apartment and issue a notice to the landlord to fix the problems. Not all Cities or Counties will do this because these days they don't have the budget to do much of a job protecting their citizens. You may have to find a private tenant rights attorney, and go after the landlord through that attorney. What you have to be careful of, and understand that the landlord might attempt to retaliate against you if you complain by evicting you. This is not legal (generally speaking), but unless you can fight it with legal cause, you could be evicted for just standing up for your rights. This is why a lawyer on your side is going to be critical. Good luck.
