Legal Question in Landlord & Tenant Law in California
I received an Eviction Notice, the reasons are total false. If someone tells management something, they put in your file AND USE IT FOR GROUNDS TO TERMINATE. How can I get rid of false statements from my file and eviction? State that my company hangs out front drinking and being loud. This has never happen in the 5 years I lived there and that they saw someone in the parking lot making what APPEARED to be a drug deal. Also not true. I just recently wrote letter to main company regarding that my request for repairs have not been taken care of and it has been a year now and still nothing. It is costing me my health, due to the fact that a large rodent eaten through the duct and using air/heat blow in their dust and waste. Shut 3 of the 5 vents which any cooling or heat goes to the attic, and that has double my utility bill. Since that letter, I have had trouble with management.

First you need to decide whether or not you are going to fight the eviction matter or just move. Given the problems you have had with the management, I would recommend moving and negotiating a move-out date with the management that works for you. Once you are out of the unit, you should consider suing the management company for substandard conditions, retroactive rent abatement and demand that your tenant file be purged of inaccurate information. The LL/Management is responsible for maintaining your tenant file as a business record, but you are entitled to review the records and if necessary identify incorrect information and request the removal of such information.
