Legal Question in Landlord & Tenant Law in California
I was recently evicted from what was once a hotel, that transitioned into an apartment building. Back in my everyone in the building was given a letter informing tenants that the status of the building was being changef from hotel to apartment building. So moving forward I moved out at the end of August. I put in change of address form with the post office. And my mail never was forwarded. I subimitted the change of address form 3 times during the month of sept and still to this day my mail has not bee forwarded and this is why....The post office informs me that beecause my old address was listed as a bussiness with the post offfice and not a residental address that I was unable to forward my mail. I have contacted my apt manager and she ignores my letters and my phone calls. There has to be something I can do inorder to get the to change what they are listed as with the post office. This is a 60 unit apartment building. When the mail is delivered its handed over to the Manager and she sorts in in boxes that only she can accesss and we have to as for it in the lobby. There has to be some type of law that requires them to be listed or register with the correct type of address. The post office forwarded my call to the department of consumer afffairs and they informed me to put my request in writting and if they dont respond that I could sue. Is this possible? I have had tons of mail, and bills returned. The manager knows the situation and that how Im unable to forward it but she still sends all my mail back. Can I sue her for not properly updating the status of the building witht the post office and for sending all my mail back ?

It sounds like your residence was registered as a mail receiving agency, just like a UPS Store or Mailboxes, Etc. In order to do that, they must agree to offer mail forwarding services to their customers who no longer wish to or are qualified to receive mail at that address, because the Post Office will not honor forwarding from those multiple boxes. It would be too confusing and mail would get misdirected. You need to file a complaint with the Post Office. You may have to go to the Postal Service police, since I think it may be a crime for the manager not to forward your mail.
