what recourse does a tenant have when they have just moved into a unit in which the people below are smoking cigarettes and marijuana. They just moved in and it's suppose to be a non-smoking community.

Notify the landlord immediately. If not rectified within a reasonable time, you might explain in a letter to the landlord why you are moving. A smoke-free environment to you was a material term of your rental agreement. You might then seek your moving costs in small claims court.
