Legal Question in Landlord & Tenant Law in California

Reimburse for mold tests?

My tenant suspected that the home had mold. He didn't inform me and went out and got a test done ($700). The test was positive. I called a remediation company, they ordered new mold tests (which I paid for) because the one the tenant had ordered didn't include a protocol. We had the mold remediated and the home is now safe and sound. The tenant is asking me to reimburse him for the mold tests that he had performed even though 1) They never even informed me that I had mold or asked me if they could hav a test done and 2) The tests had to be re-done since it didn't include a ''protocol''.

Your feedback would be greatly appreciated!

Thanks!

Re: Reimburse for mold tests?

You are welcome, and thanks for the "thanks". They are few and far between.

Your tenant was wrong. He should have written a certified letter, asking you to perform tests, or letting you know tests would be done by a date certain, if you did not respond affirmatively.
