reimbursement for damages

I rent a condo from an individual. Three weeks ago, the hot water heater in the unit above broke and caused water damage to the ceiling and floor in my unit. The insurance company of the owner upstairs is repairing my unit. Partial repairs have been made, but I cannot live there until all repairs are made and the place is cleaned due to a high amount of resulting dust (and possibly asbestos) and my allergies. Who is responsible for my expenses while I cannot live there and what should I be reimbursed for - my rent and utilities, other accomodations, extra gasoline and food costs - while I cannot live there?

If you don't have renters insurance, you should demand reimbursement from your landlord, and he will demand reimbursement from the neighbor's insurance company. You should not have to live there during repairs. Good Luck
