Legal Question in Landlord & Tenant Law in California

Removal of occupants

I have a house that a relative has been living in. They stopped paying in 7/04. I have now sold the house and they are refusing to vacate for a termite inspection. There is no written or implied landlord/tenant agreement. The house is in my name only. How can I have them removed?

Re: Removal of occupants

You can give a 30 day notice and then have an attorney help you with an eviction action if they do not leave. Please contact our office if you have any other questions.

They aretenants, like any other renter. You will need to give them the correct formal notice to terminate the tenancy (or a 3-day notice to pay all back rent or move). If they do not move, you will need to file formal eviction proceedings.
