Legal Question in Landlord & Tenant Law in California
I currently rent a home from my ex boyfriend, (he is the homeowner and we have a child together). I have lived there a little under a year, and due to my Cancer treatments, I have not been able to make the $750.00 a month rent which we verbally agreed on. We never filled out a rental contract. I have been short on the rent for the last 4 months. He has stated that he wants me out, and that he has filed eviction paperwork in a San Diego court. (I live in Frazier Park, CA which is located in Kern County.) I helped him save this house when we were together approx. 12 years ago. By this I mean we both gave up alot of our belongings as collateral for a loan from a "loan shark". It is possible to show proof of my contribution, but finding the receipts could be a lengthy process so I'm not sure if this would have any validity. I just need to know what rights I have, or how long I can stay in the home. I need to buy as much time as possible due to my health situation. Your help in this matter would be greatly appreciated.

Well for starters you can stay in the home until he files a proper eviction proceeding. He can't file an eviction in San Diego County on a rental in Kern County. The court should throw it out.
