Rent Increase Durring my lease

I live in the city of Sherman Oaks and moved into my current apartment june 1st of 2006 signing a 1 year lease. My building was taken over by new owners in September of '06 and just a few days ago I was served with notice that my rent will be increased by 4% begining March 1st. Are the new owners able to increase my rent even though I am still under a lease that has not ended yet?

Not if the rent is specified in the original lease. The new owner takes the property subject to all leases. I would suggest sending a copy of the lease by certified/return receipt mail (keep a copy), telling them that they're obliged to honor the contract. If they refuse, you could take legal action or go to the city's Rent Stabilization Board and file a complaint. Good luck.

If your lease does not contain a clause to allow an increase, the new landlord cannot increase your rent. Maybe a strong letter from an attorney may help you. We would need to review your lease if you want our assistance.
