Legal Question in Landlord & Tenant Law in California
rent reduction ?
I recently moved into a brand new apartment complex. I pay $1461 a month for a one bedroom one bath.I pay this much because it is supposed to be fully equiped, fridge ,stove, washer dryer,microwave,etc...On the 2nd of August, my microwave stopped heating food so I contacted management about this. It took them a week and a half before they came out and took serial numbers from it and said it would be another week. Its now Sept.1st and still no working micro.Im paying for a fully functional apartment , I expect a fully functional apt. for the price Im paying. Rent is due today and I want a discount on this months rent. Is this possible or am I way out of line. Thanks for your help

Re: rent reduction ?
Under California law, you have 2 options; 1. Move - but only under certain circumstances can you break the lease; consult an attorney; 2. send written notification of the problem and your intent to use one months rent to repair; this is called a repair and deduct. However, you must give the owner/manager reasonable time to repair the item.
Therefore, do not deduct until the following month.
