Legal Question in Landlord & Tenant Law in California

If there is no rental agreement and the landlord let the tennant move his things in with no monies, with a promise to pay, and the tennant got put in jail before the time of promise to pay, can the landlord hold tennants belongings for money due? The tennants mom has power of attny to get his things, but the LL sez not until money is given to him...What can we do?

The landlord must follow the procedures set forth for abandoned property - just as if the tenant had lived there and left the property when he moved out. No, you cannot hold the property for payment of the rent.
