Legal Question in Landlord & Tenant Law in California

Rental Deposit return

I live in CA. I got Move-Out Report 33 days after I moved out and they asked me to pay $835 plus my deposit $500 for the damage. there was no formal invoice and just a receipt. Should I pay them or based on the CA Civil Code Section 1950.5, I should go to the court to dispute? Thank you!

Go to court!!

To my knowledge, there is no such animal as a "move-out report".

Furthermore, California law requires the landlord to refund the deposit, minus deductions, within 21 days. When there are deductions, the landlord must present invoice and receipts.

Because this may affect your credit negatively, I suggest you retain a lawyer to write a letter to landlord demanding your deposit at once.

I also would demand a citation of the law allowing a "move-out report" after 33 days, without an explanation or invoice.

Please feel free to e-mail, or call, my office if you need more.
