Rental due dates

I recieved a notice asking for the rent to be paid on the first day of every month or a 10% late charge would be added. When we moved in was on the 5th of the month and we paid for a full months rent and the deposit. My households income is recieved on the 5th of the month and that is why we moved in on the 5th of the month. Can I be charged this fee if I cannot pay my rent on the 1st.
