rental eviction due to short sale
My husband and I have rented our home in CA for 2 years. Our landlord was selling the home in a short sale due to not being able to refinance. He asked us to stay in the home until the house sold. We got a call on Sunday from his realtor to tell us that we had 30 days to vacate because they had a buyer. The landlord told us we were going to have 60 days once it sold. Today I find out that the landlord is not listed on the home loan and that he has been pocketing the rent money in lieu of paying the bank. And today the landlord also showed up with an 60 day eviction noticed and asked for his rent money. Becausae our lease expired on 5/08 and have been month to month since and because he is not listed as the owner of this property can he still evict us and collect the rent? I don't have a problem with leaving but, would it hurt us if we dont pay him. We don't even know if we will see our deposit money either.
