Legal Question in Landlord & Tenant Law in California

my rental lease is broken after said it was un permitted/ inspected

After a visit from the Code Compliance officer in my city, my landlord has told me I must vacate in 1 1/2 weeks. Apparently, my rental unit was constructed by the previous property owner without permits or code inspections. The officer stated my unit must be demolished or brought up to code through a complete rehab.

I have lived here for the last 3 years. The current owner purchased the property only 4 months ago and I signed a 1 year lease at that time--The lease ends on Nov 1 2007. In this type of situation does the landlord have any legal/financial responsibility to me for breaking the lease 9 mo. early? How about financial reimbursements for the previous 4 months rent I paid him as well? Thanks alot!

Dianne

You may have an action for the breach of the lease, however, the landlord's defense may be accepted by the court as an impossibility to perform. Past rent would be reimbursed if the premesis were inhabitable. Call me directly or e-mail me at the address below.
