Renters Rights

I rent a house with 2 other tenants, the one year lease expired in Oct. 2006 and now i want to move out due to a dispute with one roommate. What are my rights? Thank you.

Since the lease expired in 10/06, you're likely on a "month to month" term of the lease. You should be able to give your 30-day notice per lease and move out accordingly. This will also apply to your roommates, requiring them to either move out or sign a new lease.

As a practical matter, despite the apparent deterioration in the relationship with your roommates, I would suggest that you give them an opportunity to find a new roommate and to sign a new lease. However, I strongly recommend that you do not sublet to a new tenant -- to do so, keeps you on the lease and potentially responsible for any future breaches by your former roommates in the future.

A new lease should also enable you to get back your portion of the security deposit earlier.
